Yeah, this is definitely Fantasy. No 40k armor and other than the belt there is nothing to indicate anything to do with 40k

This is clearly Warhammer 40K
I see a Chaos Undivided symbol on the belt, and Khornate symbols all over the armor (The wierd 8-like ornaments) Also, the mace head is shaped like a symbol of Khorne too.
The color scheme hints that he is a member of the World Eaters. By the looks of it, a Chaos Lord too

Khorne is a Chaos God too in Warhammer Fantasy, and that armor is not like a Power Armour.

Besides, if you compare him with a Chaos Legion, the color scheme would be the Word Bearers, not World Eaters (They're Red and Gold, not Dark Red and Silver)
